Probate – What is a Grant of Probate?

Applying for Probate is the legal right to deal with someone’s Estate after they die. To assist your understanding of the process involved we have prepared a short summary of the key milestones, each of which we will explain to you in detail when we meet.

In summary the process is:

  1. To check if there is a will. If not you will apply for Letters of Administration.
  2. Value the estate and report it to HMRC.
  3. Apply for probate.
  4. Pay any Inheritance Tax that’s due.
  5. Collect the estate’s assets, e.g. money from the bank or the sale of the person’s property.
  6. Pay off any debts, for example unpaid utilities bills or funeral accounts.
  7. Prepare an account of how net assets will be distributed amongst beneficiaries.
  8. Distribute the assets and compete registration of property and shares as needs be.
