Luke Curran & Co. Successful in Judicial Review of Planning Permission Decision for Display Screen on Hill Street Newry.
A large Free Standing Electronic Display Screen was erected on Hill Street, Newry unlawfully as the Planning Permission Decision was made without proper neighbour notification to adjoining landowners and without having given due consideration to the impact on buildings within an area of conversation most notably Newry Cathedral. On behalf of our client we made an application to the Court for a judicial review of the decision to grant the Planning Permission for the structure. The Department of the Environment conceded to the application and Costs were awarded against them, thereby sparing the local rate payer.
A representative of Newry Parish was quoted to have been delighted with the decision given the number of the issues with the screen including the distraction it caused to Masses and services in the Cathedral.
